Privacy Policy

1. Banco Santander has designed a privacy policy and established the necessary means and procedures to fulfil it.

According to the Spanish Personal Data Protection Act (LO 15/1999 of 13 December), personal data are understood as being "any information concerning identified or identifiable individuals".

The only personal data to which Banco Santander will have access are those provided voluntarily by the user. The user must therefore be aware that personal data will be requested in order to register with certain products/services offered through the websites of Grupo Santander. Where the data expressly indicated are not provided by the user/customer, access will not be granted for use of said services and contents, e.g. data concerning identification or solvency, where the nature of the transaction requires as such, or any other data that, according to each case, are legally required or considered necessary to provide either the information requested or a particular service. Voluntary data are collected by Banco Santander for the purpose indicated in the Data Protection clause below. The privacy policies of each of the companies belonging to Grupo Santander are contained in the Legal Notices of their respective websites.

In accordance with current legislation, Banco Santander has adopted the necessary technical and organisational means to maintain the safety level required insofar as the personal data dealt with. It also has the specific mechanisms available to it to prevent unauthorised access, illicit removal and modifications and the loss of data.

However, should you publish personal information online that is accessible to the general public, you are likely to receive unrequested messages from others and your data, therefore, will be known by third parties.

The utmost care is therefore recommended, along with the use of all the security tools available. Banco Santander is not liable for the illicit removal, modification or loss of data.

Users are legally entitled to access, rectify, cancel and oppose their personal data, where applicable, and can exercise these rights in writing to the address indicated in the Data Protection Clause below. The authorisation given for the use or transfer of their data can also be revoked at any time, without prejudice to the rights of Banco Santander to cancel the contract or operation in question where said data are essential for the correct implementation thereof. The data provided to Grupo Santander through the websites may also be modified in the manner indicated therein.

2. Data Protection Clause.
A.- 1. Users, in the case of individuals, are informed that their personal data, to which Banco Santander, S.A. has access as a result of enquiries, transactions, operations, contract applications, and product and service commissioning appointed through any means or computer processes in relation to already registered data, will be included in the corresponding file of Banco Santander, S.A.. Banco Santander, S.A. is hereby authorised to treat the necessary data for its use in relation to the undertaking of the agreed operation or service. Such data will be considered compulsory.
2. Banco Santander, S.A. is also expressly authorised to use your data in the offering and contracting of products and services and for the undertaking of commercial action, whether this be general or adapted to their personal characteristics. Said commercial action may be undertaken by e-mail or equivalent electronic means of communication.
3. Users also authorise the communication or transfer of said data to companies belonging to Grupo Santander for the same purpose indicated in the above paragraphs, giving said companies the express authorisation to use e-mail or equivalent means. The interested parties are informed that said data are hereby transferred at this time to the Companies whose name, activity and registered offices are indicated below. In the event of subsequent transfers to other Companies in the Group, the parties agree that Banco Santander, S.A. will inform the interested parties of such transfers in the usual manner used to inform them of the products contracted with the Bank.
4. Users are informed of their right to oppose, access, rectify and cancel their personal data under the terms established by Law and may exercise these rights in writing together with a copy of their National Identity Document addressed to Customer Services, Ciudad Grupo Santander - Avda. de Cantabria s/n, 28660 - Boadilla del Monte (Madrid), siendo responsable del fichero Banco Santander, S.A.,. Banco Santander, S.A., with Registered Offices for these purposes at the above address, is responsible for this file.

B.- In accordance with that established in the Spanish Personal Data Protection Act, a list is hereby given of the companies in Grupo Santander to which the personal data will be transferred.
